Below is a copy of an E-mail sent by Dominic Martin on Dec. 8, 2009 that basically states he and his followers were leaving The Holy Eastern Orthodox Catholic and Apostolic Church in North America.

He has since attempted to say they voted to remove the presiding hierarch from Office, which by the Constiution they could not and cannot do.

By leaving as they did and setting up a separate altar they created a Schism.

By their recent claims they prove they are liars since the email tells the truth.

Please follow the link at the bottom of the page. You can read where a week before leaving THEOCACNA Dominic was interested in keeping peace in the Church.

We also have the Nov 23rd email that was sent suggesting any clergy who could not or would not follow the canons should consider leaving. At that suggestion they refused.

Your Beatitude:

Effective 07 December 2009 myself and the clergy under my care have unanimously voted to break communion with you for the good of our diocese, its dependencies and the people under our care.

I have mailed to you the Charters for myself, Bp. Joseph and Bp Augustine. I have asked Bp Edward to return his as well. Deacon Abe d'Iesus who has asked to come directly under my protection will be returning any documents you have issued to him. I have also returned the antimins to you in the same envelope with the charters.

We will have any and all references to THEOCACNA and its related service marks removed from the website and other published materials as soon as possible. Please be assured that we are all in agreement that we wish to state very clearly that we have absolutely nothing to do with you. In the meantime, I have instructed everyone to adopt the following statement:

As of December 7, 2009 the Archdiocese of St. Titus & the Eastern States is no longer in Communion with nor affiliated with T.H.E.O.C.A.C.N.A. under the direct control of Patriarch Nikon known in the world as Archbishop Victor Prentice.

I received the rambling email you forwarded from Chor-bishop Andrew and called to inform him of the action taken by the majority of the synod in breaking communion with you. I did not state that we deposed you as I am well aware that as Supreme Patriarch you are in office for life.

As far as the accusation that I verbally abused Andrew, this is absurd. I stated that I do not accept the explanation of him being in a "diabetic stupor". Those in such a 'stupor' are not even able to dial a phone. He did indicate that he did not wish to speak with me any further to which I responded that would be fine and that I would not contact him again. With that I ended the conversation.

I do not object to your authority. I do not object that you are in office for life. My objection was to the manner in which you speak with clergy. A Patriarch is the living image of Christ. It is my prayer that one day you will be able to follow that particular canon as well as you follow the others.

It is all a moot point now.

I have no objection to Father Paul Joseph remaining as registered agent for the secular corporation. Though he has indicated that he prefers to resign. I have left that decision in his hands.

I am sad that it has come to this, but I am hoping we can part ways in peace.
